Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and BCard ("BCard", "we", "us") and govern your access to and use of bcard.qa, our mobile experiences, NFC-enabled physical cards, and wallet passes (together, the "Service"). By creating an account, placing an order, or using any part of the Service you confirm that you accept these Terms.

If you are using the Service on behalf of a company or other legal entity, you represent that you are authorised to bind that entity, and "you" refers to that entity.

1. Eligibility

You must be at least 16 years old and capable of forming a legally binding contract in your jurisdiction. Accounts opened on behalf of a business may be used only by authorised employees or contractors of that business.

2. Your account

  • You are responsible for keeping your login credentials secret and for all activity under your account.
  • You must provide accurate, current, and complete information and keep it up to date.
  • Notify us immediately at [email protected] if you suspect unauthorised access to your account.
  • We may refuse, suspend, or terminate accounts that show signs of fraud, abuse, or impersonation.

3. Subscription plans, billing & refunds

  • Paid plans renew automatically for the same term (monthly or annually) until cancelled. You can cancel at any time from your billing dashboard; cancellation takes effect at the end of the current paid period.
  • Prices are listed on the pricing page and exclude any taxes that may apply in your jurisdiction.
  • Payments are processed by Stripe. By providing payment details you authorise us (and Stripe) to charge the applicable fee to your payment method.
  • Refunds. Software subscriptions are non-refundable once the billing period has started, except where required by law. If you believe you were charged in error, contact us within 14 days and we will investigate in good faith.
  • Failed payments. If a charge fails we may retry the payment and temporarily downgrade features on your account until payment is successful.

4. Physical NFC cards

  • Physical card orders are final once production has started (typically within 24 hours of purchase).
  • Shipping estimates are indicative, not guaranteed. Import duties and local taxes are the customer's responsibility.
  • Defective cards will be replaced free of charge if reported within 30 days of delivery with photographic evidence.

5. Acceptable use

You agree not to, and not to permit any third party to:

  • upload content that is illegal, defamatory, obscene, threatening, infringing, or that violates the rights of any third party;
  • impersonate another person, organisation, or BCard employee;
  • use the Service to send spam, phishing attempts, malware, or unsolicited marketing;
  • probe, scan, or test the vulnerability of the Service, or breach any security or authentication measure;
  • reverse-engineer, decompile, or attempt to extract source code, except to the extent permitted by law;
  • resell, sublicense, or provide the Service to third parties without our written permission;
  • use the Service to store or share sensitive personal data (health, financial account numbers, government IDs, biometrics) beyond what the Service is designed for;
  • scrape, crawl, or harvest data from the Service without our written permission.

We may remove content or suspend accounts that breach this section, with or without notice.

6. Your content

You keep ownership of everything you upload to the Service ("Your Content"). By uploading Your Content you grant BCard a worldwide, non-exclusive, royalty-free licence to host, copy, transmit, display, and adapt Your Content solely to the extent necessary to operate, secure, and improve the Service, including to generate and distribute wallet passes on your behalf.

You represent that you have all rights needed to grant this licence and that Your Content does not violate the rights of any third party. You are solely responsible for Your Content.

7. BCard intellectual property

The Service — software, design, templates, trademarks, documentation — is owned by BCard or its licensors and is protected by intellectual property laws. These Terms grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service as expressly permitted. All other rights are reserved.

8. Third-party services

The Service integrates with Stripe (payments), Apple Wallet, Google Wallet, Samsung Wallet, and other third-party providers. Your use of those services is subject to their own terms and privacy policies. BCard is not responsible for third-party services.

9. Privacy

Our Privacy Policy explains how we handle personal data and forms part of these Terms.

10. Termination

  • You may terminate your account at any time from the dashboard, which will delete your cards and associated content subject to the retention windows described in the Privacy Policy.
  • We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or if your account remains unused for more than 24 months.
  • Sections that by their nature should survive termination (for example, ownership, disclaimers, limitation of liability, governing law) will survive.

11. Disclaimers

The Service is provided "as is" and "as available". To the maximum extent permitted by law, BCard disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Service will be uninterrupted, error-free, or completely secure. BCard does not warrant that any specific wallet pass, QR code, or NFC read will work on every device, operating system version, or carrier network.

12. Limitation of liability

To the maximum extent permitted by law:

  • BCard is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, even if advised of the possibility of such damages;
  • BCard's total aggregate liability arising out of or in connection with the Service will not exceed the greater of (a) the amount you paid to BCard in the 12 months preceding the event giving rise to the claim, or (b) US $100.

Nothing in these Terms limits liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be limited under applicable law.

13. Indemnity

You agree to indemnify and hold harmless BCard and its officers, employees, and contractors from any claim, liability, damage, or expense (including reasonable legal fees) arising out of (a) Your Content, (b) your breach of these Terms, or (c) your misuse of the Service.

14. Governing law & dispute resolution

These Terms are governed by the laws of the State of Qatar, without regard to its conflict-of-laws principles. Any dispute arising out of or in connection with these Terms will first be addressed by good-faith negotiation. If it cannot be resolved within 30 days, the dispute will be submitted to the exclusive jurisdiction of the competent courts of Doha, Qatar.

Mandatory consumer-protection rights available to you under the laws of your country of residence are not affected by this clause.

15. Changes to the Service and to these Terms

We continuously improve the Service and may add, change, or remove features. If we make a material change to these Terms, we will post a notice on the Service and, for registered users, send an email at least 14 days before the change takes effect. Continued use of the Service after the effective date means you accept the revised Terms.

16. Miscellaneous

  • Entire agreement. These Terms and any referenced policies form the entire agreement between you and BCard regarding the Service.
  • Severability. If any provision is found unenforceable, the remaining provisions remain in full effect.
  • No waiver. Our failure to enforce any right is not a waiver of that right.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets.
  • Force majeure. Neither party is liable for failure to perform due to events beyond its reasonable control.
